dc.description.abstract Police undercover investigative work is one of the most effective methods for law enforcement to detect and expose organised corruption in all its multifaceted expressions. However, this form of investigation is also characterised by serious challenges such as entrapment risk, potential acceptability of evidence in court, and the imperative to balance possible contradictions between protection of the public’s rights and respect for individual rights on the other. Against this background, this study sought to assess the use of observation as a technique in the investigation of corruption in South Africa, with specific attention to the legal, ethical, and procedural approaches and steps that govern undercover operations. The research placed significant emphasis on Section 252(A) of the Criminal Procedure Act (No. 51 of 1977), the statutory foundation for the use of traps and covert investigative techniques. The analysis explored how this provision authorizes such operations while simultaneously imposing strict boundaries on their implementation. Central to the discussion was the prosecution’s responsibility to establish proof and the discretionary authority of courts in determining the admissibility of evidence obtained through undercover practices. These safeguards were identified as essential mechanisms for upholding fairness and preserving the integrity of the criminal justice system. In addition, the study interrogated the ethical complexities surrounding covert operations. Concerns such as the potential exploitation of vulnerable groups, the proportionality of harm resulting from clandestine tactics, and the necessity of robust judicial oversight were critically assessed. By engaging with existing scholarship, the research study amplified that ethical reasoning ought to be central to undercover strategies if public confidence in law enforcement is to be sustained. The study adopted a qualitative research approach grounded on the pragmatism research paradigm. Theoretical or secondary data were acquired through a review of relevant literature, legislation, policy documents, and case law analysis. Empirical data were collected through semi-structured interviews with experienced officials, including police commanders, investigators from the Directorate for Priority Crime Investigations, prosecutors from the National Prosecuting Authority, and a representative of the Royal Canadian Mounted Police. Bringing together legal sources and practitioner insights enabled the study’s contribution towards a detailed understanding of how undercover operations function in practice. The findings confirm the indispensability of police undercover operations in the fight against organised, systematic corruption. Importantly, the study established the sacrosanct requirement for such operations to take place within a strict legal and procedural framework. The study concludes in the development of a pragmatic conceptual framework accompanied by targeted recommendations designed to enhance training, reinforce oversight, and ensure stricter adherence to procedural standards. These measures are advanced with the overarching objective of reinforcing the efficiency, equity, and legitimacy of corruption investigations within the South African milieu. en

dc.description.abstract Geheime polisie-ondersoekwerk is een van die doeltreffendste metodes vir wetstoepassing om georganiseerde korrupsie in al sy veelsydige vorme op te spoor en bloot te lê. Hierdie vorm van ondersoek word egter ook gekenmerk deur ernstige uitdagings, soos verstrikkingsrisiko (entrapment risk), potensiële aanvaarbaarheid van bewyse in die hof, asook die noodsaaklikheid om moontlike teenstrydighede tussen die beskerming van die publiek se regte en die respek vir individuele regte te balanseer. Met hierdie in ag genome, is daar in hierdie studie probeer om die gebruik van waarneming as ’n tegniek in die ondersoek na korrupsie in Suid-Afrika te ontleed, met spesifieke aandag aan die wetlike, etiese en prosedurele benaderings en stappe wat geheime operasies beheer. Die navorsing het beduidende klem gelê op Artikel 252(A) van die Strafproseswet 51 van 1977, die statutêre grondslag vir die gebruik van lokvalle en geheime ondersoektegnieke. Die ontleding het ondersoek ingestel na hoe hierdie bepaling sulke operasies magtig terwyl dit terselfdertyd streng grense aan die implementering daarvan oplê. Deur regsbronne en praktisyninsigte byeen te bring kon die studie bydra tot ’n gedetailleerde begrip van hoe geheime operasies in die praktyk funksioneer. Die bevindings bevestig die onontbeerlikheid van geheime operasies deur die polisie in die stryd teen georganiseerde, sistematiese korrupsie.
